Terms & Conditions

These Terms & Conditions ("Agreement") govern all services provided by Superfly Drone Imaging ("Company," "we," "us," or "our") to the client ("Client," "you"). By booking, scheduling, or using our services, you agree to the following terms.

1. Services

Superfly Drone Imaging provides aerial photography, videography, drone inspections, and related imaging services. Specific deliverables, timelines, and pricing will be outlined in a written quote, invoice, or service agreement.

2. FAA Compliance & Safety

• All drone operations are conducted in compliance with FAA Part 107 regulations and applicable state and local laws.
• Flights are subject to airspace restrictions, weather conditions, equipment limitations, and safety considerations.
• We reserve the right to cancel or reschedule any flight if conditions are deemed unsafe or non-compliant.

3. Scheduling, Weather & Rescheduling

• Bookings are weather-dependent. Wind, rain, fog, low visibility, or temporary flight restrictions (TFRs) may require rescheduling.
• If rescheduling is required due to weather or airspace restrictions, no additional fee will be charged.
• Client-requested rescheduling with less than 24 hours’ notice may be subject to a rescheduling fee.

4. Payment Terms

• Payment terms will be specified on the invoice or booking confirmation.
• Unless otherwise stated, payment is due upon delivery of final media.
• Late payments may be subject to additional fees.

5. Cancellations

• Client cancellations made more than 24 hours prior to the scheduled service will not be charged.
• Cancellations within 24 hours of the scheduled service may incur a cancellation fee.
• If the Company cancels due to safety, weather, or legal restrictions, no fees will be charged.

6. Deliverables & Turnaround Time

• Standard turnaround time is typically 24–72 hours unless otherwise agreed.
• Deliverables will be provided digitally unless specified.
• Raw footage is not included unless explicitly agreed in writing.

7. Revisions

• Basic color correction and editing are included.
• Additional edits or revisions beyond the original scope may incur additional fees.

8. Client Responsibilities

• Client is responsible for securing any necessary property permissions, HOA approvals, or site access.
• Client represents that they have the legal right to authorize aerial imaging of the property.

9. Copyright & Usage Rights

• All images and videos remain the intellectual property of Superfly Drone Imaging.
• Upon full payment, the Client is granted a non-exclusive, non-transferable license to use the media for marketing, listing, and promotional purposes.
• Media may not be sold, transferred, or licensed to third parties without written consent.
• The Company reserves the right to use media for portfolio, marketing, website, and social media purposes unless otherwise agreed in writing.

10. Real Estate Listings

• Media is licensed for the duration of the property listing.
• Reuse for future listings or by different agents requires a new license.

11. Promotional Offer – "Your House…On The House"

• Promotional Shoots are provided at no monetary cost and include a limited set of deliverables (e.g., up to 10 interior photos and 5 exterior drone photos, MLS-ready), as specified at the time of the offer.
• Promotional Shoots are subject to availability, scheduling, weather, FAA restrictions, and safety considerations.
• All media produced during a Promotional Shoot remains the sole intellectual property of Superfly Drone Imaging.
• The Client is granted a limited, non-exclusive, non-transferable license to use the media solely for marketing the specific property associated with the Promotional Shoot.
• Promotional media may not be reused, resold, transferred, or applied to future listings, agents, or properties without written permission and an additional licensing fee.
• No guarantees are made regarding property sale, engagement, or marketing performance as a result of the Promotional Shoot.
• By accepting a Promotional Shoot, the Client agrees that the Company may use the resulting media for portfolio, advertising, website, and social media purposes without restriction.

12. Liability & Indemnification

• The Company carries general liability and drone liability insurance.
• Client agrees to indemnify and hold harmless Superfly Drone Imaging from any claims arising from Client’s misuse of the media or failure to obtain proper permissions.
• The Company is not liable for indirect, incidental, or consequential damages.

13. Property Damage

• In the unlikely event of property damage caused directly by Company operations, liability shall be limited to repair or replacement as covered by insurance.

14. Force Majeure

The Company shall not be liable for delays or failure to perform due to causes beyond reasonable control, including but not limited to weather, natural disasters, government restrictions, or equipment failure.

15. Confidentiality

Any confidential information shared by the Client will not be disclosed to third parties except as required to perform services or by law.

16. Governing Law

This Agreement shall be governed by the laws of the state in which Superfly Drone Imaging operates.

17. Modifications

These Terms & Conditions may be updated at any time. The version in effect at the time of booking shall apply.
